Terms and Conditions
(a) In these conditions:-
“The buyer” shall mean any person, firm,
company or other legal person who shall place an order
for the goods or services with the seller or any agent
of the seller referred to below.
“These Conditions” shall mean the conditions
contained on this page.
“Confidential Information” shall include,
but will not be limited to, all information which may
be imparted in confidence or be of a confidential nature
relating to:
all quotations, tenders and order forms relating to
any contract and any illustrations, drawings or other
illustrative material accompanying any quotation of
the seller or contained in the seller's catalogues,
price lists or advertisments, which the buyer receives.
“The Contract(s)” shall mean an order for
the supply or purchase of any goods or service/s either
carried out/ made by the buyer and accepted by the seller
in accordance with these conditions in either paper
or electronic format.
" The Defaulting Party” shall mean whichever
of the buyer or seller that either commits a material
breach of these conditions or any contract, or is subject
to an insolvency event as detailed in sub paragraphs
8(a) and (b).
1. (b) Terms of Payment.
(i) New contracts/ agreements in these terms are deemed
as "a new premises/ site or location in which any
of our services have been provided and therefore shall
be applicable to sub section(ii) of these terms of payment.
Thereafter sub section (iii) of these terms of payment
shall be applicable.
(ii) Payment shall be 7 days from the invoice date as
indicated on the invoice supplied by Beta Fire &
Safety to the buyer either in electronic or paper format
applicable to all services provided to cover all 'new'
agreements whether contractual or not.
(iii) Thereafter, payment shall mean the last business
day of the calender month immediately following the
calender month in which the goods and/or services (either
supplied or provided) are invoiced on, Unless any changes
to this payment date in these terms and conditions have
been specifically agreed upon in writing by the seller
and buyer.
This may be stated within the invoice or other documented
transaction. e.g. service certificate or email, which
shall be signed by both the seller and the buyer.
Email receipts for orders, quotations or services provided
from Beta Fire & Safety, will be accepted/deemed
as electronic signatures by both the buyer & seller
for the purpose of these terms and conditions.
(iv) Payment is deemed received in full in either BACS
cleared funds or cheque cleared funds. In accordance
with clause 9(a) and 9(b).
(v) Failure by the Client/ Customer to make any payment
in the due time as aforesaid shall entitle Beta Fire
& Safety & his/ her officers/ engineers to suspend
work or remove equipment that works have been carried
out on and charge interest on the amount outstanding
at 5% of the total invoice on a daily basis and charge
for administration in follow up calls, emails etc @
£25.00 per follow up.

Delivery of Equipment: Due date of payment details apply.
Beta Fire & Safety delivery promise: All standard
products available and ordered before 11.00am will be
delivered within 48-72 hours from order date request.
Carriage is free on all orders with a goods value over
£200.00 (UK Mainland). Minimum Order Value of
£20.00 applies.
On-line orders for equipment only:
UK Mainland: Order Value - Under £50.00 - Delivery
Charge (D.C.) = £25.00.
From £50.00 - £99.00 - D.C = £16.00.
From £100.00 - £199.00 - D.C = £16.00.
From £200.00 or more - D.C = FREE.

Service Charges: All prices within Beta Fire & Safety
website pages indicated are the total prices payable
for the service carried out - e.g. Fire Risk Assessment
- Small Premises @ £150.00 is charged @ £150.00
- in accordance with clauses;
3(a), 3(b) & 3(c).
Terms of agreement will apply to either contract or
non-contractual arrangements, as specified by customer
approval and
Beta Fire & Safety agreement.
3. (a) Service attendance charge = National @ £37.00.
3. (b) Service attendance charge = London @ £55.00
[Congestion Zones & Parking].
3. (c) Service attendance charge = Local @ £17.00
[5 mile radius].
4. Back Orders, Discounts and Quoted Prices: If your
equipment item is not in stock we will "Back Order"
for you. We will always email you with the option to
cancel your equipment order if you would prefer not
to wait. Discounts and quoted prices will remain the
same as quoted for up to 30 days from quotation date.

V.A.T. : Our services and equipment prices indicated
within these web pages & brochures are the total
amounts payable.
5. (a) Your invoice will indicate all applicable company
details with services, codes and costs paid.

Beta Fire & Safety Guarantee: All of our fire protection
equipment is Kitemarked and conforms to British Standards
Equipment Regulations.
6. (a) Fire extinguishers come with a five year manufacturers
guarantee.
6. (b) All of our services are carried out by qualified
& experienced fire safety professionals and have
been trained by the appropriate governing/ examining
bodies of certification within the specific fire &
safety field.
7.
Website Downloads: We have made several documents available
to you free of charge that may be of use to you in complying
with certain regulations. While every effort has been
made to ensure the data contained within is up-to-date
we must advise that legislation can vary from time to
time, therefore we recommend that if you are utilising
our free downloads you periodically check the confirmed
legislation.
7. (a) Website Links to, the health and safety executive
and the communities and local govt. websites will be
able to confirm any updated requirements you may seek.
Alternatively you can contact us for further information.
7. (b) Computer Virus: Whilst every effort has been
made to ensure our documents are virus free, we cannot
accept any responsibility for any viruses, malfunctions
or other isssues that could be experienced in using
any of our documentation. The downloads are free and
for your guidance purposes and assistance. It is the
responsibility of the party utilising them to ensure
information is kept up-to-date and that suitable virus
checkers are installed on the individual PC used to
download the documents.
8.
Delivery and cancellation
(a) If no time for delivery is specified in the contract
the buyer shall be bound to accept the goods when they
are ready for delivery by the seller to the buyer at
the buyers premises.
(b) If a time for delivery is specified, the goods may
be delivered in advance of the quoted delivery date
provided the seller gives reasonable notice to the buyer.
(c) Delivery shall be deemed to have taken place and
the risk in the goods shall pass to the buyer when the
goods (or any part thereof, when there is more than
one delivery under the contract) are delivered to the
buyer or its nominee in accordance with its instruction.
(d) Where the contract involves more than one delivery,
each delivery will constitute a separate contract and
any failuire or defect in any one delivery which entitles
the buyer to treat that contract as repudiated shall
not entitle the buyer to treat any other contract as
repudiated.
(e) Any contractual times or dates for delivery are
estimates only and accordingly time of delivery shall
not be of the essence of any contract.
(f) All costs of storage, insurance, and other expenses
incurred as a result of the buyer’s failure to
accept delivery or give the seller adequate delivery
instructions (otherwise than by reason of the seller’s
default) will be for the buyer’s account.
(g) No order which has been accepted by the seller may
be cancelled by the buyer except with the agreement
in writing of the seller and on terms that the buyer
shall indemnify the seller in full for costs incurred
prior to such cancellation.
9.
Title
(a) Property and title in and to the goods and services
shall remain with the seller as legal (and where applicable
equitable) owner as the seller’s sole and absolute
property until such time as the buyer shall have paid
to the seller. (i) the price for the goods and/or services
(in cash or cleared funds) in full and any interest
and charges relating thereto, and (ii) paid all other
sums due to the seller from the buyer (whether under
any contract or otherwise).
(b) The buyer shall hold the goods or safety service
documents and each of them on a fiduciary basis as bailee
for the seller until all sums are paid in accordance
with clause 9(a) and property in the goods has passed
to the buyer.
10.
Images
(a) Pictures of products detailed within our website
are advertised as products you can receive, should the
particular product image not be available at time of
order then we will provide a suitable replacement product
of the same type e.g. foam extinguisher for foam extinguisher.
Should the product replacement be of higher cost to
Beta Fire & Safety then we ensure you will not be
charged any extra cost. ALL products supplied shall
comply to British Standards requirements.
(b) Images/ Pictures taken on-location at your premises
with regards to fire risk assessments may from time
to time appear on our website as fire safety examples.
However, no details will be attached to the image or
provided by Beta Fire & Safety with regards to where
the image was taken.
(c) If for any reason, you prefer Beta Fire & Safety
not to publish images taken through our assessments
onto our website, please notify us in writing, via email
or letter and we will immediately remove the image/s.
(d) We do not disclose any information/ personal details
of customers whatsoever.
